Decatur County Registry Laws and Requirements

Indiana's sex offender registry runs under IC 11-8-8, which is often called Zachary's Law. The law has been in effect since January 1, 2003. It was named after Zachary Snider, a child from Cloverdale, Indiana, who was killed by a registered sex offender. The law makes Indiana's registry public and requires all 92 county sheriffs to participate.

Under IC 11-8-8-4.5, a wide range of offenses require registration. These include rape, child molesting, child exploitation, criminal deviate conduct, sexual misconduct with a minor, voyeurism involving minors, and certain out-of-state convictions that would count as qualifying offenses under Indiana law. People convicted of violent crimes such as murder may also need to register if their case involved a sexual component.

Under IC 11-8-8-7, anyone moving to Indiana with a prior qualifying conviction must register within 72 hours. Failing to register or missing a verification check is a Level 6 felony. A second offense is a Level 5 felony, which carries a longer prison term.

Note: Residency restrictions under Indiana law bar certain offenders from living within 1,000 feet of schools, parks, or youth centers.

Decatur County Registration Periods

How long someone must stay on the Decatur County sex offender registry depends on the offense. Most offenders are required to register for 10 years from the date they were released from prison, or from the end of their probation or parole, whichever comes later. After 10 years, they may petition to be removed from the registry if they have met all conditions.

Sexually violent predators (SVPs) must register for life. People convicted of offenses against victims under age 12 are also required to register for life. There is no petition process for lifetime registrants. SVPs also have stricter check-in rules. Most registrants verify their address once a year by appearing in person at the sheriff's office. SVPs must verify every 90 days.

Any change in address, employment, vehicle, or online identifier must be reported to the Decatur County Sheriff's Office within 72 hours of the change. This applies whether the offender is moving within the county or leaving the county entirely. If an offender moves out of Indiana, they must notify both the current county sheriff and register in their new state.

Who Must Register in Decatur County

Registration covers more people than just those who live in Decatur County. Under Indiana law, a person must register with the county sheriff wherever they live, work, or go to school. So if someone lives in a neighboring county but commutes to a job in Greensburg, they may need to be registered in Decatur County as well.

The Indiana Department of Correction maintains oversight of the statewide registry and works with county sheriffs to make sure offenders who are released from state prison are connected with the right county sheriff for registration. Decatur County receives notification when an offender is released who lists Decatur County as their intended home address.

People who are on probation, parole, or community corrections supervision must still register. Supervision does not replace the registry requirement. Both apply at the same time. If you are unsure whether a specific conviction triggers a registration requirement, the Decatur County Sheriff's Office can help clarify the rules.

Note: Under IC 36-2-13-5.5, county sheriffs are required by law to keep sex offender registry data publicly available.
