Delaware County Sheriff Registration Requirements

Registration in Delaware County is handled in person at the sheriff's office on Tillotson Avenue in Muncie. Anyone required to register who lives, works, or attends school in Delaware County must appear at this location. The 72-hour registration window begins at the time of release from prison, parole, or probation, or upon arriving in the county if moving from another location.

At registration, offenders must provide their full legal name and any aliases, date of birth, home address, employer name and work address, school information if applicable, vehicle descriptions and plate numbers, and all online accounts including email and social media. A photo is taken at each visit and becomes part of the public record. Delaware County Sex Offender Laws

Indiana's sex offender registry law is IC 11-8-8, known as Zachary's Law. The law has been in force since January 1, 2003, and was named in memory of Zachary Snider, a child from Cloverdale, Indiana, who was killed by a registered sex offender. The law requires all 92 Indiana county sheriffs to maintain a public registry and share data with the statewide system.

The offenses that require registration are defined in IC 11-8-8-4.5. Qualifying offenses include rape, child molesting, child exploitation, possession of child pornography, criminal deviate conduct, sexual misconduct with a minor, and voyeurism involving minors. Certain violent offenses and out-of-state convictions that would meet Indiana's definition of a sex offense also qualify.

The requirement to register within 72 hours is spelled out in IC 11-8-8-7. Missing a registration or failing to appear for a verification check is a Level 6 felony. A second violation is a Level 5 felony, which carries a prison term of one to six years. Delaware County law enforcement takes these violations seriously and actively tracks registrant compliance.

Delaware County Verification and Reporting Periods

Most sex offenders registered in Delaware County must verify their registration once a year. This means appearing in person at the Delaware County Sheriff's Office, confirming their current address, employment, and other details, and having a new photo taken. The annual check is required even if nothing has changed. Failure to appear is a criminal offense.

Sexually violent predators (SVPs) must verify their registration every 90 days rather than annually. This stricter schedule applies for life. SVPs and people convicted of crimes against victims under age 12 are required to register for life with no option to petition for removal. Standard registrants are generally on the registry for 10 years, counted from the end of their sentence, probation, or parole.

Any change in address, job, vehicle, or online account must be reported within 72 hours of the change. Moving out of Delaware County does not end the reporting obligation. Offenders who leave the county must notify the Delaware County Sheriff and register with the sheriff in their new county or state within the 72-hour window.

Delaware County Residency Restrictions

Indiana law limits where certain sex offenders can live in Delaware County. Offenders against children cannot establish a residence within 1,000 feet of a school, public park, or youth program center. This rule applies across the county and is enforced by the Delaware County Sheriff's Office. A violation is a Level 6 felony, separate from any failure-to-register charge.

Beyond the 1,000-foot rule, offenders generally cannot live within one mile of their victim's home. Before moving to any new address in Muncie or anywhere else in Delaware County, offenders should confirm with the sheriff's office that the address complies with all restrictions.
