Hamilton County Sheriff and Prosecutor Sex Offender Unit
Hamilton County's approach to sex offender registration is more structured than many Indiana counties. The Sheriff's Office handles the day-to-day registration process, but the Hamilton County Prosecuting Attorney's Office runs a dedicated Sex Offender Unit that works alongside the sheriff. Registered sex offenders must have their registered home address approved by the Prosecuting Attorney's Office to ensure offenders are not in violation of state-mandated residency restrictions. This review process is in addition to the standard sheriff registration.
The Sex Offender Unit at the Prosecuting Attorney's Office can be reached through their website at hcpros.org/sexual-offender-unit. If you are a registrant who needs to get a new address approved before moving, start with this office. If you are a resident trying to report a compliance issue, contact either the Sex Offender Unit or the Hamilton County Sheriff at 317-773-1872. Both offices coordinate closely on compliance matters.
The Hamilton County Sheriff works with the Indiana Sheriffs' Association and the Indiana Department of Correction to coordinate registration when offenders are released from state prisons or move from other counties.
Hamilton County Sex Offender Registry Laws
Indiana's sex offender registry is governed by IC 11-8-8, known as Zachary's Law. This law took effect January 1, 2003. It was named after Zachary Snider of Cloverdale, Indiana, a child who was murdered by a registered sex offender. The law requires all 92 Indiana county sheriffs to maintain a public registry and share data with the statewide system at no cost.
The offenses that require registration are set out in IC 11-8-8-4.5. These include rape, child molesting, child exploitation, possession of child pornography, criminal deviate conduct, sexual misconduct with a minor, and voyeurism involving minors. Qualifying out-of-state convictions and certain violent crimes also require registration. Hamilton County is one of Indiana's fastest-growing counties, which means the sheriff and prosecutor's office actively monitor new residents for prior registration obligations.
The 72-hour registration window is in IC 11-8-8-7. Failing to register is a Level 6 felony. A second violation is a Level 5 felony, with one to six years in prison. County sheriffs must keep registry data publicly available under IC 36-2-13-5.5.
Hamilton County Registration Periods and Verification
Most sex offenders in Hamilton County must register for 10 years. The period starts when the person is released from incarceration, or when probation or parole ends, whichever is later. After 10 years without new violations, the offender may petition a court to be removed from the registry. Hamilton County courts review these petitions and consider the full record before ruling.
Sexually violent predators and those convicted of crimes against victims under age 12 must register for life with no petition option. SVPs also check in every 90 days rather than annually. All other registrants verify their registration once per year. Each verification requires an in-person visit to the Hamilton County Sheriff's Office at 18100 Cumberland Road in Noblesville, where the registrant confirms current information and has a new photo taken. Because Hamilton County requires Prosecuting Attorney approval for addresses, registrants should also keep that office informed of any address changes.
All changes in address, employment, vehicle, or online accounts must be reported within 72 hours. Offenders who move out of Hamilton County must notify the county sheriff and register in the new county or state within the same 72-hour window. Failing to report a change is a criminal offense under Indiana law.
Hamilton County Residency Restrictions
Indiana law bars certain sex offenders from living within 1,000 feet of a school, public park, or youth program center. This applies to offenders against children throughout Hamilton County. Violating the restriction is a Level 6 felony. Offenders must also avoid living within one mile of their victim's home address.
Hamilton County adds a layer to these requirements by requiring all registered sex offenders to get their home address approved by the Prosecuting Attorney's Sex Offender Unit before moving there. This approval process is meant to ensure the address is not inside a restricted zone and that no conditions of the offender's sentence or registration are violated. If you are a registrant planning to move within Hamilton County or into the county from another area, contact the Sex Offender Unit at hcpros.org/sexual-offender-unit and the Hamilton County Sheriff at 317-773-1872 before finalizing any move.
Note: Probation or parole conditions may impose further geographic limits on top of what state law and the county require.
