Registration Requirements in Martin County
Indiana Code IC 11-8-8-7 sets the registration deadline at 72 hours. Anyone with a qualifying sex offense conviction must register within 72 hours of being released from incarceration, moving to a new address, or arriving in Indiana from another state. There are no exceptions. Registration is done in person at the Martin County Sheriff's Office.
Registrants must provide their full legal name and any aliases, date of birth, current home address, employer name and work address, school if enrolled, all vehicle information, and every email address and social media account. The office photographs each registrant at every visit. This information feeds the statewide OffenderWatch database, which powers the public iCrimeWatch search tool. Any change in home address, work location, or school enrollment must be reported within 72 hours.
Most registrants verify once each year. Sexually violent predators must verify every 90 days. Missing a verification visit is a Level 6 felony under IC 11-8-8-17. That means up to 2.5 years in prison and a fine up to $10,000. A second failure bumps the charge to a Level 5 felony. Homeless registrants must check in with the Martin County Sheriff every seven days.
Note: A person working in Martin County who lives in a neighboring county must register their work address with the Martin County Sheriff within 72 hours of starting that job.
Who Must Register in Martin County
Indiana Code IC 11-8-8-4.5 lists which offenses require registration. These include rape, child molesting, child exploitation, sexual misconduct with a minor, voyeurism involving minors, and criminal deviate conduct. Out-of-state and federal convictions that meet Indiana's definitions also require registration. Some violent offenders without sex offense records may also appear in the registry system.
The standard registration length is 10 years. Sexually violent predators and those whose crimes involved victims under age 12 must register for life. The Indiana Department of Correction handles SVP classification. Details on how classifications work are at in.gov/idoc.
Zachary's Law in Martin County
Indiana's sex and violent offender registry is built on IC 11-8-8, commonly called Zachary's Law. It took effect January 1, 2003, named for Zachary Snider, a child from Cloverdale killed by a registered sex offender. The law created a unified statewide system across all 92 Indiana counties, including Martin County. Every county uses the same OffenderWatch platform to track and share registry data.
Under IC 36-2-13-5.5, the Martin County Sheriff is legally required to maintain the registry and keep it free and public. Martin County registrants also appear in the national database at NSOPW.gov, which can be searched from any location in the country.
Residency Restrictions in Martin County
Persons classified as "offenders against children" are prohibited from living within 1,000 feet of a school, public park, or youth program center in Martin County. They also cannot reside within one mile of a victim's home address. These rules apply throughout Shoals and every part of Martin County. Violating these restrictions is a Level 6 felony.
Martin County's rural layout can make it harder to identify restricted zones without local knowledge. Small schools, parks, and community centers are scattered through the county. Anyone subject to registration who plans to move into Martin County should contact the sheriff's office before settling on an address to verify it falls outside restricted zones.
