Indiana Sex Offender Law and Zachary's Law

Indiana's sex offender registry is built on IC 11-8-8, known as Zachary's Law. It took effect January 1, 2003. The law was named for Zachary Snider, a child from Cloverdale who was killed by a registered sex offender who had not been properly tracked. The law created the public registry, established registration requirements, and set penalties for non-compliance. It covers all 92 counties, including Monroe.

The Indiana Department of Correction oversees the statewide registry system and coordinates with county sheriffs. Under IC 36-2-13-5.5, county sheriffs are legally required to maintain a free, public, online registry. The registry covers more than just residents. Anyone who lives in Monroe County, works in the county, or attends school here is listed. A person with a Bloomington employer who lives in Lawrence County still must register their work address with the Monroe County Sheriff. Who Must Register in Monroe County

IC 11-8-8-4.5 lists all qualifying offenses. Registration is required for convictions involving rape, child molesting, child exploitation, criminal deviate conduct, sexual misconduct with a minor, voyeurism involving a minor, and comparable offenses from other states or federal courts. Some violent offenders without a sex offense conviction may also be required to register if their offense involved a minor.

People moving to Monroe County from out of state must register within 72 hours of arriving if they have a qualifying conviction from any other state. This applies even if that state's registration period has expired. Indiana makes an independent determination of whether the out-of-state offense requires registration under Indiana law.
