Elkhart County Sheriff Registration Process

All sex offender registrations in Elkhart County go through the Elkhart County Sheriff's Office. Offenders who live, work, or attend school anywhere in the county must register in person. Indiana law requires this to be done within 72 hours of release from prison, parole, or probation, or within 72 hours of arriving in the county from another location.

During the registration visit, offenders must give their full legal name and any other names they use, date of birth, home and mailing address, employer details, school information if applicable, vehicle descriptions and plate numbers, and all online accounts such as email and social media. A photo is taken at the time of registration and updated at each verification visit. All this information is entered into the statewide database and made public through iCrimeWatch and the sheriff's own registry page.

The Elkhart County Sheriff works with the Indiana Sheriffs' Association and all 91 other county sheriffs to keep registry data current statewide. The Indiana Department of Correction also coordinates with county sheriffs when offenders are released from state prisons.

Elkhart County Sex Offender Registry Laws

Indiana's sex offender registry is governed by IC 11-8-8, known as Zachary's Law. This law came into effect on January 1, 2003. It was named after Zachary Snider of Cloverdale, Indiana, a child who was murdered by a sex offender who had a prior conviction. The law made Indiana's registry public and required all 92 counties to participate in the statewide system.

The offenses requiring registration are spelled out in IC 11-8-8-4.5. These include rape, child molesting, child exploitation, possession of child pornography, criminal deviate conduct, sexual misconduct with a minor, and voyeurism involving minors. Certain violent crimes and qualifying out-of-state convictions also trigger the registration requirement.

The 72-hour rule for new arrivals is set out in IC 11-8-8-7. Failing to register or missing a verification appointment is a Level 6 felony. A second violation is charged as a Level 5 felony. The Elkhart County Sheriff actively tracks compliance and works with local prosecutors when violations occur.

Registration Periods and Verification in Elkhart County

Most sex offenders in Elkhart County must register for 10 years. The 10-year period starts when the offender is released from prison, or when probation or parole ends, whichever comes later. At the end of 10 years, if the offender has no new violations or criminal charges, they may petition a court to be removed from the registry. The court reviews the petition and rules based on the offender's history and risk level.

Sexually violent predators and people convicted of offenses against victims under age 12 must register for life. There is no petition option for these registrants. SVPs must also verify their registration every 90 days, while standard registrants check in once a year. Each check-in requires appearing in person at the Elkhart County Sheriff's Office to confirm current information and have a new photo taken.

Any change in address, employment, vehicle, or online account must be reported within 72 hours. An offender who moves out of Elkhart County must notify the county sheriff and register with the sheriff in the new location within that same window. Failing to report a change is treated the same as failing to register and is charged as a felony.

Elkhart County Residency Restrictions

Indiana law prevents certain sex offenders from living within 1,000 feet of a school, public park, or youth program center. This restriction applies to anyone classified as an offender against children under Indiana law. The limit applies anywhere in Elkhart County, including Goshen, Elkhart city, and other communities in the county. Violating the residency restriction is a Level 6 felony, on top of any other registration-related charges.

Offenders must also stay more than one mile from their victim's home address. These rules affect where a registrant can legally live, whether they own or rent. Before moving to any new address in Elkhart County, registered offenders should contact the sheriff's office to confirm the address is in compliance.
