Fulton County Sex Offender Registry Laws

Indiana's registry is built on IC 11-8-8, commonly called Zachary's Law. This law has been in effect since January 1, 2003. It was named after Zachary Snider of Cloverdale, Indiana, a child who was killed by a person with a prior sex offense conviction. The law requires all 92 Indiana county sheriffs to maintain a public sex offender registry and share that data with the statewide system at no cost.

The offenses that require registration are spelled out in IC 11-8-8-4.5. These include rape, child molesting, child exploitation, possession of child pornography, criminal deviate conduct, sexual misconduct with a minor, and voyeurism involving minors. Qualifying out-of-state convictions and certain violent crimes also trigger registration in Indiana.

The 72-hour rule is set out in IC 11-8-8-7. Failing to register or missing a check-in is a Level 6 felony. A second offense is charged as a Level 5 felony, with a sentence of one to six years. Under IC 36-2-13-5.5, sheriffs must keep the registry publicly available at no charge.

After 10 years with no new offenses or violations, a person can petition a court for removal from the registry. The court reviews the petition and decides based on the full record.

Sexually violent predators and those convicted of offenses involving victims under age 12 must register for life. SVPs also check in every 90 days rather than once a year. All other registrants verify their registration annually.
