Gibson County Sex Offender Registry Laws

Indiana's sex offender registry is governed by IC 11-8-8, known as Zachary's Law. This law came into effect January 1, 2003. It was named for Zachary Snider of Cloverdale, Indiana, a child killed by a registered sex offender. The law requires all 92 Indiana county sheriffs to maintain a public registry and share data with the statewide system at no cost to the public.

The offenses requiring registration are listed in IC 11-8-8-4.5. These include rape, child molesting, child exploitation, possession of child pornography, criminal deviate conduct, sexual misconduct with a minor, and voyeurism involving minors. Out-of-state convictions that would qualify under Indiana law also require registration. Gibson County borders Illinois, and offenders who were convicted in Illinois and move to Gibson County must register here if their offense qualifies.

The 72-hour registration window is set out in IC 11-8-8-7. Failure to register or missing a verification appointment is a Level 6 felony. A second offense is charged as a Level 5 felony, with one to six years in prison. County sheriffs are required by IC 36-2-13-5.5 to keep registry data publicly available online.

Gibson County Registration Periods

Most people on the Gibson County sex offender registry must stay registered for 10 years. The period starts when the offender is released from incarceration, or when probation or parole ends, whichever is later. After 10 years without new violations, the offender may petition a court for removal from the registry. The court weighs the full criminal record and current risk level before deciding.

Sexually violent predators and people convicted of crimes against victims under age 12 must register for life. There is no petition process for these individuals. SVPs check in every 90 days, while all other registrants verify their registration once per year. Each visit requires appearing in person at the Gibson County Sheriff's Office in Princeton to confirm address, employment, vehicle, and online account information, and to have a new photo taken.

Any change in address, employer, vehicle, or online accounts must be reported within 72 hours of the change. Offenders who move out of Gibson County must notify the Gibson County Sheriff and register with the sheriff in their new location within that same 72-hour window. Failing to report a change is treated as a criminal offense under Indiana law.
