Indiana Sex Offender Registration Law
Indiana's sex and violent offender registry is based on IC 11-8-8, a law known as Zachary's Law. It has been in effect since January 1, 2003. The law was named after Zachary Snider, a child in Cloverdale, Indiana who was murdered by a convicted sex offender who had moved into the neighborhood without public notice. The law created a statewide registry that is free and open to the public.
Under Zachary's Law, county sheriffs are the primary point of contact for registration and verification. The Indiana Department of Correction manages the state-level framework and coordinates with sheriffs when offenders are released from state prison. The Indiana Sheriffs' Association maintains the centralized database that links all 92 county sheriffs together into a single searchable system.
The law requires offenders to register within 72 hours of release from incarceration, or within 72 hours of any change to their address, job, or school enrollment. This is a hard deadline with no grace period. Courts treat late registration the same as intentional non-compliance.
Who Must Register in Wabash County
People convicted of qualifying sex offenses must register. Those offenses include rape, child molesting, sexual misconduct with a minor, criminal deviate conduct, child exploitation, possession or distribution of child pornography, and voyeurism involving a minor. Certain violent offenses, including murder under specific statutes, may also require registration as a violent offender.
Registration covers anyone who lives, works, or attends school in Wabash County. An offender who lives in Miami County or Cass County but works in Wabash County must register here as well as in their home county. People moving to Indiana from another state with a qualifying prior conviction must register in Indiana within 72 hours of arriving.
People who are unsure whether their conviction requires registration in Indiana should contact an attorney or the Indiana Department of Correction before the 72-hour window closes. Guessing wrong can result in a felony charge.
Registration Process and Penalties
Initial registration requires appearing in person at the Wabash County Sheriff's Department. You must provide your full legal name and any other names you have used, date of birth, current home address, employer name and address, vehicle information, and all internet identifiers including email addresses and social media accounts. A photograph is taken at each visit.
Most registrants verify once per year. Sexually violent predators must verify every 90 days. Both require in-person visits to the sheriff's office. Missing a scheduled verification is a Level 6 felony under IC 11-8-8-17, carrying a sentence of six months to two and a half years in prison. A second offense escalates to a Level 5 felony with a sentence of one to six years.
Standard registration lasts 10 years from the end of the full sentence. Sexually violent predators and those convicted of crimes against children under age 12 must register for life. Life registration does not expire automatically. A court petition is required for removal, and approval is not guaranteed.
