DeKalb County Sex Offender Registry Laws

Indiana's registry is governed by IC 11-8-8, commonly called Zachary's Law. This law took effect January 1, 2003. It was named for Zachary Snider of Cloverdale, Indiana, a child killed by a registered sex offender. The law requires every county in Indiana to maintain a public sex offender registry and share it with the state system at no cost to the public.

The list of offenses that trigger a registration requirement is set out in IC 11-8-8-4.5. Qualifying offenses include rape, child molesting, child exploitation, possession of child pornography, criminal deviate conduct, sexual misconduct with a minor, and voyeurism involving minors. Some violent crimes without a direct sexual element can also require registration. Out-of-state convictions that would be qualifying offenses under Indiana law count as well.

Under IC 11-8-8-7, anyone moving to Indiana with a prior qualifying conviction must register within 72 hours of arriving. DeKalb County deputies enforce these requirements across the county's 362-square-mile patrol area. Failing to register or missing a check-in appointment is a Level 6 felony. A repeat offense can be charged as a Level 5 felony.

How Long Offenders Stay on the DeKalb Registry

Registration length depends on the offense and the offender's classification. Most people on the registry must register for 10 years. The 10-year period starts from the date of release from incarceration, or from the end of probation or parole, whichever is later. After 10 years with no new offenses, an offender may petition a court to be removed from the registry.

Sexually violent predators (SVPs) and people convicted of crimes against children under age 12 must register for life. There is no petition process for them. SVPs also must check in every 90 days rather than once a year. Every visit requires appearing in person at the DeKalb County Sheriff's Office in Auburn to confirm their current address, employment, and other registration details.

Standard registrants verify once per year. Missing a verification appointment is a criminal offense under Indiana law. The sheriff's office tracks these appointments and follows up when someone does not appear. If you have questions about the length of registration for a specific person, contact the DeKalb County Sheriff at (260) 925-3365.

Residency Rules for DeKalb County Offenders

Indiana places limits on where certain sex offenders can live. People classified as offenders against children cannot reside within 1,000 feet of a school, public park, or youth program center. This restriction applies throughout DeKalb County just as it does statewide. Violating the residency rule is a Level 6 felony on its own, separate from any failure-to-register charge.

Offenders must also avoid living within one mile of their victim's home. These rules affect where a registrant can rent, buy a home, or stay temporarily. Before moving to any new address in DeKalb County, registered offenders should confirm with the sheriff's office that the address does not fall within a restricted zone. The county website at co.dekalb.in.us has additional contact information for county offices.

Note: Parole or probation conditions may impose stricter limits than state law alone requires.
