Indiana Registration Law

Sex offender registration in Indiana is governed by Indiana Code 11-8-8, commonly called Zachary's Law after Zachary Snider, a child murdered in Cloverdale by a sex offender who had moved nearby without registering. The law has been in effect since January 1, 2003, and continues to be updated by the Indiana Legislature.

Zachary's Law covers a wide range of triggering offenses. These include rape, sexual battery, child exploitation, child solicitation, voyeurism in certain circumstances, and internet-based sex crimes. The duty to register applies to Indiana convictions and to out-of-state convictions for comparable offenses. Anyone released from an Indiana prison or county jail with a qualifying conviction must register before or immediately after release.

Registration length is set by offense tier under IC 11-8-8-7. Most registrants carry a 10-year term. Sexually violent predators and those convicted of crimes against children under 12 register for life. The Indiana Department of Correction assigns SVP status and coordinates with county sheriffs statewide.

Reporting Requirements for Registrants

Porter County sex offenders must report any change of home address, employer, or school within 72 hours of the change. This includes temporary stays, not just permanent moves. Under IC 11-8-8-4.5, registrants without a fixed home must check in with the sheriff's office every seven days and disclose where they slept during that period.

Annual in-person verification is required for standard registrants. Sexually violent predators must verify every 90 days. At each visit, a new photograph is taken and all address and employment information is confirmed. Missing a scheduled verification is treated the same as failing to register.

Penalties for Non-Compliance

Failure to register or to update registration on time is a Level 6 felony under IC 11-8-8-17. A Level 6 felony carries up to two and a half years in prison and a $10,000 fine. A second failure-to-register offense is charged as a Level 5 felony with a longer sentence. The Porter County prosecutor handles these cases, and the sheriff refers non-compliant offenders for prosecution as a matter of course.

If you have information about a registered sex offender in Porter County who has moved or changed jobs without updating the registry, call the Porter County Sheriff's Office at (219) 477-3000. You can also report through the iCrimeWatch portal or contact the Indiana Sheriffs' Association.

Residency Restrictions in Porter County

Indiana prohibits registered sex offenders from living within 1,000 feet of schools, parks, or youth program centers. The law also requires offenders to stay at least one mile from their victim's residence. These rules apply everywhere in Porter County, from Valparaiso and Portage to the smaller communities and unincorporated areas throughout the county.

Porter County's communities include Valparaiso, Portage, Chesterton, and Merrillville-adjacent areas. School districts and park systems are spread throughout the county, so the 1,000-foot rule can significantly limit where a registered offender can rent or buy a home. The IC 36-2-13-5.5 statute gives the sheriff authority to enforce these restrictions locally.
