What Registry Records Show
Each entry in the Whitley County sex offender registry starts with the person's full legal name and all known aliases. A current photograph taken at the most recent registration or verification visit is part of every public record. The home address appears, as does employer name and work address when that information has been provided and verified. The specific offense that required registration is listed along with the conviction date and the jurisdiction where it took place.
Physical details such as height, weight, hair color, eye color, and race are part of each record. Vehicle information including make, model, color, and license plate may also be shown. Online identifiers such as email addresses and social media usernames are collected at each registration visit but may not all be visible in the public search results. For more complete data on a specific person, contact the Whitley County Sheriff at 260-248-3130.
Records are updated each time an offender checks in for scheduled verification or reports a change. If a record appears out of date or incorrect, report it to the Sheriff's Office or contact the Indiana Department of Correction's sex and violent offender registry division.
Indiana Law: IC 11-8-8 and Zachary's Law
Indiana's sex offender registry runs under IC 11-8-8, called Zachary's Law. It took effect January 1, 2003, named for Zachary Snider, a child from Cloverdale, Indiana, who was killed by a person with a prior sex offense conviction. The law requires all 92 Indiana county sheriffs to maintain a public sex offender registry and share data with the statewide system. Public searches cost nothing.
IC 11-8-8-4.5 lists the qualifying offenses: rape, child molesting, criminal deviate conduct, sexual misconduct with a minor, child exploitation, incest, possession of child pornography, and voyeurism involving minors. Persons convicted of equivalent offenses in other states must also register in Indiana after moving here. Whitley County's location in northeastern Indiana, close to the Ohio border through Allen County, means it often receives registrants with prior Ohio convictions.
IC 11-8-8-7 sets the 72-hour registration deadline. It runs from release from prison, end of probation or parole, or arrival in a new county. Failure to register within that window is a Level 6 felony. A second failure-to-register offense is a Level 5 felony, with a sentencing range of one to six years in state prison.
Registration Periods and Verification Requirements
Most sex offenders in Whitley County must remain on the registry for 10 years. The 10-year period starts on the date of release from incarceration or the end of supervised release, whichever is later. After completing the full period without any new violations, the person may petition an Indiana court to be removed from the registry. The court reviews the full criminal record and current public safety risk before ruling.
Sexually violent predators and persons convicted of crimes against victims under age 12 must register for life. No petition process is available for these individuals. SVPs check in at the Whitley County Sheriff's Office every 90 days. All other registrants appear once per year. Each visit requires an in-person appearance at the Columbia City office and a new photograph. Do not skip a scheduled check-in; missing one is a criminal offense.
Between check-ins, any change to address, employer, vehicle, or online accounts must be reported within 72 hours of the change. An offender who moves out of Whitley County must notify this sheriff and register in the new county within 72 hours. These reporting deadlines are strict and failure to meet them results in felony charges.
Residency Restrictions
Indiana law bars certain registered sex offenders from living within 1,000 feet of a school, public park, youth program center, or licensed child care facility. This applies to offenders convicted of crimes against minors and covers all of Whitley County, including Columbia City and the surrounding rural areas. A violation of the 1,000-foot restriction is a Level 6 felony. Offenders must also stay at least one mile from their victim's current home address.
Individual probation and parole terms often add restrictions beyond what state law requires. These case-specific conditions vary widely. Any registrant planning to move to a new address in Whitley County should first contact the Sheriff's Office at 260-248-3130 to confirm the address is lawful. The 1,000-foot rule applies to owned properties, rentals, and any temporary stays. A short-term stay at a non-compliant address is still a violation.
Law enforcement in Whitley County conducts periodic address verification checks to confirm compliance. Neighbors and community members can also report suspected violations to the Sheriff's Department.
